Every cloud has a silver lining — even an ash cloud. First Iceland’s Eyjafjallajokull produced a mysterious display of lightning seemingly erupting directly from the mouth of the volcano. (See the amazing lightning slide show here.) Millions of people worldwide have been watching the volcanic drama via webcam, AFP reports.

And now the Northern Lights have been rippling across the Icelandic sky over Eyjafjallajokull. Scientists tell the Associated Press that the sky over all of Europe is bluer because of the eruption — so startlingly clear that it has already inspired Britain’s poet laureate, Carol Ann Duffy, to write: “Five miles up the hush and shush of ash/Yet the sky is as clean as a white slate/I could write my childhood there.”

Many hotels with exercise facilities also provide in-room workouts through programs like the cable station Exercise TV, http://www.exercisetv.tv/. Others, such as selected Marriotts, will set up a Wii Fit on request. Some Westin hotels — http://bit.ly/WhmHe — even have exercise equipment in selected guest rooms. Sheraton hotels offer free “workout in a bag” kits, with a mat, stretch rope, and other items for guests to use in their rooms.

Being able to exercise on the road is critical to business travel, said Ben Schwartzman, a Boise-based lawyer who flies around the country for his litigation work.

“Everything else being equal, I’ll try to find a hotel that has better exercise facilities,” said Schwartzman, 40. “To me, that’s a selling point for a hotel.”

And the quality of the facility matters. Like Morel, Schwartzman doesn’t care for doing his workout on 1980s-era equipment in an ill-lit basement room.

“Some of these facilities are so unappetizing you really don’t feel like doing anything there,” said Schwartzman. “I prefer to go back to my room and do yoga.”

Fortunately, travelers who are willing to do their homework have lots of choices. Here are some options for staying fit on the road.

_A low-tech hotel room workout: Jennifer Galardi, a dance and fitness trainer for Exercise TV, believes you can get a good workout anywhere, even without a gym. _Yoga: Schwartzman researches online before he travels to find a good yoga studio near his hotel. In the absence of a studio, he carries a yoga mat and does yoga in his hotel room. The site has running routes in all 50 states plus dozens of other countries (five in Cambodia alone). Visitors can choose from 2-mile, 5-mile, and more demanding routes.

_Athletic-Minded Traveler: This site — http://www.athleticmindedtraveler.com/home.php — like Morel’s HotelGymReview.com, reviews hotel gym facilities. But it uses professional reviewers and it concentrates on major cities. It includes reviews of running loops, lap pools, and places to eat.

While the top-end resorts and clubs do tend to have the most up-to-date, comfortable gyms, choosing a high-priced hotel is no guarantee you’ll find a top-quality gym there, said Morel, who lives in Calgary.

“Some unknown hotels have a beautiful gym,” he noted.

In the absence of a good gym, Galardi recommended that travelers just use what’s at hand.

“There are a number of things you can do without equipment,” said Galardi, who travels frequently for her job and often works out using hotel furniture — including chairs, for leg-strengthening squats. “Resistance bands don’t take up a lot of room in a suitcase, or weigh a lot.

“I think people get spoiled,” she said. “They’re used to the best and the latest equipment, but you don’t need it. Actually the older things are better because you need to work hard to make them work.”

Galardi said she often stretches after she gets off a plane, before her luggage appears on the carousel.

Finding healthy food on the road is another challenge, noted Galardi, who recommends stocking up on snacks like apples or almonds before you get on a plane.

“It’s not like they serve food on planes anyway, but avoid being tempted by the biscotti on Delta,” Galardi advised. “It’s all about being prepared.”

PHILADELPHIA – A second lawsuit has been filed against a suburban Philadelphia school district accused of spying on students through cameras in school-issued laptop computers.

Jalil Hasan, who graduated from Lower Merion High School last spring, says the school district activated remote-tracking software after he left the laptop at school Dec. 18.

The lawsuit filed Tuesday in federal court says the laptop was returned three days later, but the surveillance software remained activated for about two months.

The suit alleges that more than 1,000 photos were taken, 469 from the webcam and 543 screen shots.

Attorney Mark Haltzman is representing Hasan and his family, as well as the family that filed the original lawsuit against the district in February. Henry E. Hockeimer Jr., who represents the district, has declined comment.

Lawyer question about a personal injury case?

I have a lawyer who just sent me a letter tell me that he will not be able to work on my case on a contigent basic fee. It also told me to seek another lawyer if I think I have a case. What should I do. Do I have to pay the next lawyer.

Depending on which county the lawsuit is filed in, the discovery phase can take many months or sometimes more than a year. When discovery is completed, and each side knows what evidence will be offered at trial, this is the time when the parties may conduct settlement discussions. Sometimes the parties will engage in alternative ways to resolve the case, like mediation. In mediation, the parties agree to hire a retired judge or an experienced attorney who will assist the parties in reaching a settlement. Mediation is voluntary and nonbinding (unless a settlement is reached). A mediation session is also confidential so anything that is said during the session cannot be used at trial. Many times mediation can be used to successfully resolve a case involving children. Mediation sessions can occur in one day or last several days, depending on the complexity of the case.

The settlement of a child’s injury case also requires court approval. A Settlement Guardian ad Litem (SGAL) must also be appointed by the court (please refer to Chapter 7 which explains the settlement process for child injury claims). It may be advantageous to appoint the SGAL early in the case so this person can be fully apprised of all developments during the course of the litigation. Sometimes it may be advantageous to have the SGAL attend and/or participate in mediation to assist the attorney in settlement talks.

If the case does not settle after discovery has ended, the case will then proceed to trial. Each side has the option of trying the case before a judge or jury. A jury trial does not happen automatically. One party must specifically request that the case be decided by a jury as opposed to a judge. Most often the defense will request a jury. This is accomplished by filing a document in court called a “jury demand” and then paying a “jury fee” to the clerk. The court rules usually require that certain documents must be filed and exchanged within 30 to 60 days before the trial date. These documents may include witness and exhibit lists, motions, trial memorandums, and jury instructions, among others.

Understandably, most parents want to avoid going to trial in their child’s personal injury case. Trials are stressful and can cause additional anxiety for everyone involved. Usually a trial is the last resort to resolve the child’s case. Oftentimes the insurance company will not want a serious or significant child injury case to go to trial, particularly when there is no serious dispute about fault for the accident and the severity of the injury. However, some the insurance companies have a reputation of utilizing “scorched earth” litigation tactics by needlessly forcing and prolonging the litigation process in an effort to wear down the attorney and force a smaller settlement. Sometimes this will include forcing an unnecessary trial, particularly if the insurance company is convinced that the child’s attorney has little experience in trying accident cases in court. Usually, it is only by threatening and preparing for trial that the child’s attorney will be able to secure a reasonable and just settlement offer for the child. This is why it is extremely important that the parent retain an attorney who has experience trying cases in court. You don’t want to use a lawyer for a serious injury case only to find out a few weeks or months before trial that the lawyer has either never tried a case in court or that the lawyer is afraid to try the case. In those situations, it may be too late to hire another attorney to take over. Many of the most experienced and reputable personal injury attorneys who handle children cases may refuse to take over a case so late in the process, especially if the trial date is only a few months away. Of course, there may be exceptions but this is usually a situation for parents to avoid.

A trial will also necessitate a decision about whether the injured child should appear and/or testify in court. Not every case requires the testimony of the injured child. There are strategic reasons for and against having the child testify in court. The primary consideration has to be the health and best interests of the child.
